Wrongful Death
Nothing is more devasting than the death of a loved one due to negligence. The law recognizes that when a victim dies needlessly because a person or a company was careless, whether in an auto accident, by medical malpractice, nursing home neglect, or any other form of negligence, the relatives of the victim as well as the "estate" of the victim deserve to be compensated by the person or company that caused the wrongful death.
Spouses, children, and often parents and other relatives are entitled to recover compensation for the mental and emotional pain and suffering that they endure due to the wrongful death of their loved one, as well as compensation for the replacement value of the services that the loved one had performed. Additionally, compensation is awarded to the estate of the victim, which is then usually transferred immediately from the estate to the family, for the loss of income, and the loss of ability to earn money in the future, as well as any outstanding medical bills. For instance, if a person is 45 years old and earns $75,000 a year when he suffers a wrongful death, then his family is entitled to compensation for all the years that the victim had left - and not with just 75,000.00 for each of the twenty years or so until the time he would have likely retired, but also with the raises and other increases one would normally expect over those twenty years, depending on the victim's type of occupation.
At Weinstein & Weinstein, P.A., we have expert economists and vocational experts who in these tragic circumstances have convincingly testified for us and submitted comprehensive reports that persuasively show these type of future losses, which have helped us collect millions of dollars in damages for the families of victims who have suffered a wrongful death.
Most importantly, as a married couple with children, Mark and Rhonda truly bring a unique perspective and authority to the courtroom or mediation room when describing to a jury or insurance company the importance of partnership and reliance on each other in marriage, and thus the devastation caused when that relationship is ripped apart by a carless, needless wrongful death. When Mark and Rhonda stand together before a jury to represent you in the wrongful death of your spouse, the importance of marriage to that jury is self-evident. It is something that helps set us apart.
As our past results demonstrate, Mark and Rhonda have been extremely successful at obtaining full and fair compensation for the negligent, wrongful death of a husband, wife, parent or child. For families that are the victims of such an unfair tragedy as a negligently caused wrongful death, we can help.
